What are the Directive Principles of State Policy?
The Directive Principles of State Policy (DPSPs) are guidelines in Part IV of the Indian Constitution, from Articles 36 to 51, that are fundamental to the governance of the country. They aim to establish social and economic democracy but are not legally enforceable by the courts for their violation (Constitution of India, Article 37).
What is the role of the Supreme Court in Constitutional Law?
The Supreme Court of India serves as the apex constitutional court, exercising extensive original, appellate, and advisory jurisdictions. Its primary role is to uphold the Constitution, and its decisions are binding on all courts, with the inherent power to pass orders necessary for complete justice (Article 141 and Article 142 of the Constitution of India).
How does the Constitution of India ensure separation of powers?
It depends. The Constitution does not strictly recognize absolute separation of powers; however, it sufficiently differentiates the functions of the Legislature, Executive, and Judiciary, incorporating a system of checks and balances to prevent autocracy (Ram Jawayya v. State of Punjab AIR 1955 SC 549).
What is the relationship between International Law and Municipal Law?
India primarily follows a Dualist approach, meaning International Law generally requires legislative action to be transformed into Municipal Law before it is legally binding domestically (Gramophone Company of India Ltd. vs. Birendra Bahadur Pandey & Ors. (1984)). However, Courts may apply International Law, especially human rights norms, when domestic law is silent or ambiguous (Vishaka & Ors. vs. State of Rajasthan & Ors. (1997)).
